Emirates Shipping Association’s Associate Member, Stephenson Harwood, in conjunction with the organising committee of Dubai Arbitration Week 2023 (“DAW”), is pleased to invite you to attend our panel discussion on ‘DIAC Rules and Maritime Arbitration’.
As the Decree No 34 of 2021 merged the operations of EMAC, the dedicated maritime arbitration centre, into those of DIAC, many parties who had incorporated the very light touch EMAC arbitration, or the non-maritime specific DIFC-LCIA arbitration, into their contracts now have to arbitrate their disputes before DIAC.
During this session, we will examine some of the provisions of the DIAC Rules, which are of particular relevance in the maritime context. We will analyse whether or not they suitably cater for the needs of the maritime community and will also compare them against the approach adopted by other arbitral institutions or rules frequently used by the industry. Some of the areas for discussion include the ease of commencing proceedings, speed of proceedings and joinder and consolidation of proceedings.
This session would be of relevance to professionals operating in the maritime sector who had previously incorporated EMAC and DIFC-LCIA arbitration clauses in their contracts or are now considering whether or not to elect for DIAC arbitration in their upcoming contracts.
